This Privacy Policy explains how ListaCRM collects, uses, and protects your personal and business data.

This Privacy Policy explains how Lista CRM collects, uses, discloses, and protects personal information and business-related data when you use the Lista CRM platform, websites, microsites, integrations, and related services (collectively, the “Platform” or “Services”). Lista CRM is operated by E-Systematic LLC (“Lista CRM,” “we,” “us,” or “our”).

This Privacy Policy applies to information we collect when:

  • you create an account or use Lista CRM;

  • you interact with Lista CRM websites, pages, or hosted microsites;

  • you connect third-party services such as Meta (Facebook and Instagram), messaging providers, MLS / IDX services, domains, or other business tools;

  • you communicate with us for support, billing, or account management; or

  • you use customer-facing forms, lead capture tools, saved search tools, alerts, and related features powered by Lista CRM.

By accessing or using Lista CRM, you acknowledge the practices described in this Privacy Policy.


1. Scope of this Privacy Policy

This Privacy Policy applies to personal information and related data processed by Lista CRM in connection with the Platform. Depending on the context, Lista CRM may process information:

  • as a business operating its own platform, such as when we process account, billing, support, and website visitor information; and/or

  • on behalf of our customers, such as when our customers use Lista CRM to collect, manage, and communicate with leads, contacts, buyers, sellers, tenants, owners, and other end users through CRM records, forms, microsites, alerts, and similar features.

If you are a visitor, lead, buyer, seller, or consumer interacting with a real estate professional’s Lista CRM-powered microsite or form, some of your information may be processed by Lista CRM on behalf of that customer.


2. Information We Collect

Depending on how you use Lista CRM and which features are enabled, we may collect the following categories of information:

2.1 Account and Business Information

We may collect information such as:

  • name

  • email address

  • phone number

  • company, brokerage, team, office, and agent details

  • account role, permissions, and workspace information

  • billing contact details and subscription-related records

  • support requests and account communications

2.2 CRM and Customer Data

We may process CRM data that you or your authorized users upload, import, create, sync, or manage through the Platform, including:

  • leads, contacts, prospects, buyers, sellers, renters, owners, and other customer records

  • notes, tasks, activities, tags, timelines, and internal comments

  • property inquiries, saved properties, saved searches, and property alerts

  • deal, pipeline, and transaction-related information

  • listing-related information and marketing content

  • communications, follow-up history, and campaign records

  • form submissions, valuation requests, and market report requests

2.3 Microsite, Form, and Consumer Account Information

If you use Lista CRM microsites or customer-facing features, we may collect information submitted by visitors, leads, and end users through those experiences, including:

  • contact form submissions

  • listing inquiry submissions

  • request-tour submissions

  • property valuation requests

  • market report signups

  • account registration details for consumer-facing accounts

  • saved search, favorites, and alert preferences

  • other information a visitor or lead submits through your pages or forms

2.4 Communications Data

We may process communications data related to your use of the Platform, including:

  • emails sent, received, or logged through supported features or integrations

  • SMS messages sent through supported messaging features or providers

  • delivery, status, and engagement information associated with such communications where available

  • message templates, communication preferences, and related logs

2.5 Meta and Third-Party Integration Data

If you connect Facebook, Instagram, or other supported third-party services, we may receive information made available by those services based on the permissions you grant and the functionality you enable. Depending on the integration, this may include:

  • profile or business account information

  • Page information

  • lead form submissions

  • advertising lead data

  • account identifiers and asset identifiers

  • other lead-related or integration-related information made available by the provider

2.6 MLS / IDX and Listing-Related Data

If you enable MLS / IDX, listing search, listing detail, market reports, or related real estate data features, we may process listing-related information, search activity, listing references, and compliance-related data needed to operate those features.

2.7 Usage, Device, and Technical Data

We automatically collect certain technical and usage information when you access or use the Platform, including:

  • IP address

  • approximate location derived from IP

  • browser type, operating system, device information, and device identifiers

  • pages viewed, features used, clicks, sessions, timestamps, referring URLs, and log data

  • account activity, authentication events, and system usage records

  • error logs, performance information, and diagnostics

2.8 Analytics, Tracking, and Routing Data

To support reporting, lead attribution, microsite analytics, routing, and related functionality, we may collect and process information such as:

  • source URLs and referring pages

  • UTM parameters and campaign attribution data

  • page visits, listing views, saved listings, repeat visits, and search behavior

  • lead source, page ownership, routing results, and assignment history

  • interaction history with forms, alerts, or microsite content

2.9 Cookies and Similar Technologies

We and our service providers may use cookies, pixels, tags, local storage, and similar technologies to operate the Platform, remember preferences, analyze usage, improve performance, and support security and reporting. More information is provided in Section 10 below.


3. How We Use Information

We may use the information we collect for the following purposes:

  • to create, maintain, and administer user accounts, workspaces, teams, and subscriptions;

  • to provide CRM, microsite, marketing, routing, reporting, and account-management features;

  • to operate contact forms, property inquiries, valuation requests, market report signups, consumer accounts, saved searches, favorites, and alerts;

  • to support MLS / IDX, listing search, listing detail, and related listing workflows where enabled;

  • to import, organize, store, route, and manage leads, contacts, and customer records;

  • to send, log, or support communications you initiate through the Platform, including email and SMS messages;

  • to provide onboarding, customer support, account administration, billing, and troubleshooting;

  • to monitor, secure, maintain, and improve the Platform and its features;

  • to analyze performance, engagement, routing, attribution, and product usage;

  • to investigate suspicious activity, fraud, abuse, policy violations, or security incidents;

  • to comply with legal obligations, enforce our agreements, and protect our rights, users, customers, and services; and

  • for other purposes disclosed at the time of collection or as otherwise permitted by law.

We do not sell personal information.


4. Legal Bases and Customer Responsibilities

Depending on the applicable law and the context in which information is processed, Lista CRM may rely on one or more legal bases for processing, including performance of a contract, legitimate interests, consent, and compliance with legal obligations.

If you use Lista CRM to collect, upload, import, store, or communicate with leads, contacts, buyers, sellers, or other individuals, you are responsible for ensuring that you have the notices, permissions, consents, and other lawful bases required by applicable law to collect and use that information and to communicate with those individuals.


5. SMS Messaging

Lista CRM may allow customers to send SMS messages through supported features or third-party messaging providers.

If you use SMS functionality through Lista CRM, you are solely responsible for obtaining all legally required consent before sending messages and for complying with applicable messaging, telemarketing, privacy, and carrier rules, including the U.S. Telephone Consumer Protection Act (TCPA) and A2P / 10DLC requirements where applicable.

Recipients may be able to opt out of SMS communications, and customers are responsible for honoring opt-out requests as required by law and provider rules.


6. Meta (Facebook & Instagram) and Third-Party Platform Data

If you connect Lista CRM with Meta services such as Facebook or Instagram, or with other third-party platforms, we may receive limited information from those platforms based on the permissions you grant and the integrations you enable.

We use such information only to support the Platform and requested functionality, including account connection, lead import, asset synchronization, reporting, communications, and related CRM workflows.

We do not sell Meta user data and do not disclose Meta data to third parties for their own advertising or resale purposes. Our use of information received from Meta APIs is intended to comply with applicable Meta Platform Terms, Developer Policies, and other platform requirements.

Please note that third-party platforms control the data they make available, and may change their APIs, permissions, features, or policies at any time.


7. How We Share Information

We may share information in the following circumstances:

7.1 Service Providers

We may share information with vendors, contractors, hosting providers, cloud infrastructure providers, analytics providers, messaging providers, support providers, payment processors, and other service providers that perform services on our behalf and need access to information to support the Platform.

7.2 Third-Party Integrations Authorized by You

If you connect third-party services or enable integrations, we may share or receive information with or from those services as necessary to provide the requested integration or functionality.

7.3 Workspace, Team, and Brokerage Administration

Information associated with an account, workspace, team, brokerage, or microsite may be visible to or accessible by authorized owners, administrators, team leaders, office administrators, brokerage administrators, or similar supervisory users within the applicable customer organization, subject to the Platform’s configuration and applicable law.

7.4 Legal Compliance and Protection

We may disclose information if we believe disclosure is necessary to:

  • comply with applicable law, legal process, subpoena, or governmental request;

  • enforce our agreements, policies, or rights;

  • investigate fraud, abuse, security incidents, or suspected violations;

  • protect the rights, property, or safety of Lista CRM, our customers, users, or others; or

  • respond to emergencies or other urgent circumstances.

7.5 Business Transfers

We may disclose or transfer information in connection with a merger, acquisition, financing, asset sale, corporate reorganization, bankruptcy, or similar business transaction.

We do not sell personal information to third parties.


8. Data Security

We use administrative, technical, and organizational safeguards designed to protect information against unauthorized access, misuse, loss, alteration, or disclosure. These measures may include access controls, authentication measures, logging, vendor management, secure infrastructure practices, and other security controls appropriate to the nature of the Services.

However, no system, network, or transmission method is completely secure, and we cannot guarantee absolute security.

You are responsible for protecting your account credentials, devices, and connected third-party accounts, and for maintaining appropriate internal access controls for your team or organization.


9. Data Retention

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

  • provide and maintain the Services;

  • support customer accounts, subscriptions, and requested features;

  • comply with legal, tax, accounting, regulatory, or contractual obligations;

  • resolve disputes and enforce agreements;

  • maintain security, backups, and business continuity;

  • preserve logs, audit records, routing records, billing records, or compliance-related records where reasonably necessary.

Retention periods may vary depending on the type of information, the customer relationship, the nature of the feature being used, legal obligations, and operational requirements.

If you close your account or request deletion, we may retain certain information as permitted or required by law, for legitimate business purposes, or for backup and security purposes for a limited period.


10. Cookies, Analytics & Tracking Technologies

Lista CRM and its service providers may use cookies and similar technologies to:

  • keep users signed in and maintain sessions;

  • remember settings and preferences;

  • operate forms, microsites, and user-facing functionality;

  • analyze site and platform traffic, engagement, and performance;

  • support attribution, lead-source analysis, and product analytics;

  • improve the Services and troubleshoot technical issues; and

  • help maintain platform security and prevent abuse.

Depending on the feature, these technologies may be used on Lista CRM-controlled websites, customer-facing microsites, landing pages, forms, and related pages hosted or powered by Lista CRM.

You can control certain cookies through your browser settings. Please note that disabling some cookies may affect the functionality of the Platform or certain microsite features.


11. Your Rights and Choices

Depending on your location and applicable law, you may have certain rights regarding personal information, including the right to:

  • request access to certain personal information;

  • request correction of inaccurate information;

  • request deletion of certain information;

  • request a copy or export of certain data, where available;

  • object to or request restriction of certain processing in some circumstances; and

  • exercise other rights available under applicable privacy laws.

If you are a California resident or a resident of another U.S. state with an applicable privacy law, you may have additional rights under that law, subject to any exemptions or limitations that apply.

If Lista CRM processes your information on behalf of one of our customers (for example, if you submitted your information through a real estate professional’s Lista CRM-powered form or microsite), you may need to direct your request to that customer in the first instance, because they may control the relevant CRM data.

12. Meta Data Deletion Requests

If you used Facebook or Instagram in connection with Lista CRM and would like data associated with that integration deleted, you may contact info@listacrm.com with your request details and the relevant account information. We will review and process requests in accordance with applicable law, our role in the processing, and applicable platform requirements.


13. Children’s Privacy

Lista CRM is intended for use by businesses and professionals and is not directed to children under 18. We do not knowingly collect personal information directly from children in a manner that requires parental consent under applicable law.

If you believe that a child has provided personal information to us inappropriately, please contact us so that we can review and take appropriate action.


14. International Data Processing

Lista CRM is operated from the United States and may process or store information in the United States or in other jurisdictions where our service providers operate. By using the Platform, you understand that your information may be transferred to and processed in jurisdictions that may have data protection laws different from those in your country or state.


15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we may post the updated version on our website, update the effective date, or provide additional notice where required by law. Your continued use of Lista CRM after the effective date of an updated Privacy Policy means that you acknowledge the revised policy.
